In Afghanistan, Futures Group is implementing the Health Policy Project (HPP), a global, 5 year cooperative agreement funded by USAID. The overall goal of HPP is to strengthen developing country national and sub-national policy, advocacy, and governance for strategic, equitable, and sustainable health programming. HPP focuses on key health issues—namely, family planning/reproductive health (FP/RH), HIV, and maternal health (MH)—while also promoting health systems strengthening and program integration.

A key activity within the HPP Afghanistan work plan is to build the capacity of the MoPH to design, negotiate and manage PPPs.  With support from the earlier USAID-funded project (COMPRI-A), the MOPH PPP Unit was established within the MoPH General Directorate of Policy and Planning to design, negotiate, and manage large PPPs, starting with hospital PPPs and scaling up to other areas, such as the pharmaceutical sector. HPP is providing technical assistance to the PPP Unit to, among other things, develop supportive legislation to enable required PPP activities within Afghanistan’s legal framework; develop PPP guidelines and manuals; finalize a PPP lease agreement; and finalize the operation and maintenance agreement.

We are currently recruiting a Legal Advisor to provide legal advice and technical assistance on matters relating to securing and managing large hospital PPPs.

Specifically, the Legal Advisor consultant will:

  • Lead finalization of the draft PPP regulation;
  • Undertake legal due diligence and assist in the preparation of all aspects of securing a PPP hospital lease and performance contracts by reviewing relevant Afghan laws and HPP technical documents, including PPP feasibility studies and value for money assessments, to ensure project risks are appropriately borne by the successful private sector bidder;
  • Provide written opinions on legal and regulatory matters related to PPP project development;
  • Assist the PPP Unit in drafting and finalizing upcoming hospital PPP agreements;
  • Provide legal input in all phases of procurement, including, but not limited to: tender documentation (service standards, performance indicators, payment mechanism, and all other contractual aspects), bid evaluation and negotiation prior to financial closure;
  • Ensure international PPP probity and transparency standards are incorporated in the above processes;
  • Provide on-the-job training on PPP legal matters to the PPP Unit.

You will demonstrate:

  • University degree in Law, Master’s degree preferred;
  • At least 5-7 years of professional, verifiable experience in legal aspects of PPPs, especially hospital PPPs;
  • Experience in drafting and negotiating complex PPP/Concession agreements;
  • Excellent written and spoken English Language.

Proposed timeline

The consultancy timeline is from August 1 – October 31, 2013.  The maximum number of days for this consultancy is 48 days, not to exceed 6 days in any one week or 8 hours in a day. This is inclusive of remote work and 2 trips to Kabul for periods of 3 weeks (August and September/October).
