Organizational ContextUnder the umbrella of the Ministry of Finance of the Government of Afghanistan, the General Directorate of Property Affairs also known as Amlak is mandated to the registration of public and private properties in the capital and provinces. The General Directorate of Amlak also helps its clients in the resolution of land and property related issues.The Civilian Technical Assistance Programme (CTAP) is an Afghan government programme that aims to create stronger government institutions with more effective structures, efficient processes and skilled personnel. It assists Afghan government organizations to implement capacity development and performance improvement programmes by providing them with skilled international technical experts and capacity development advisors. On behalf of the Amlak Department, CTAP is now seeking to fill the position of Property Affairs Advisor to work at the Ministry of Finance’s General Directorate of Property Affairs, under the management of the General Director of Property Affairs/Amlak. This position is open to international passport holders only: Afghan expatriates and nationals of regional countries are especially encouraged to apply.
Position2.1 Nature and Scope of AssignmentThis assignment involves supporting a government-led capacity development programme within Ministry of Finance’s General Directorate of Amlak. Under the supervision of the Director General of Amlak, the successful candidate will provide technical advice, management support and technical inputs required to allow Amlak Department to achieve the target of proper management of property related issues. The successful applicant will be expected to work with and through his/her Afghan national counterparts, and to progressively transfer skills and expertise to them. This position does not involve any of type of management or line responsibilities under any circumstance.
2.2 Duties and ResponsibilitiesWorking with the Amlak Department team as counterparts, with assistance from the CTAP Capacity Development team and other relevant staff, the Property Affairs Advisor will:• Standardize the system for registration of public and private property;• Establish a system for the resolution of property related issues and conflicts in the capital and provinces;• Put a system in place that will help the Amlak Department in identifying individuals and entities who have illegally occupied public property as well as help it in the re-possession of this property;• Assist Amlak Department in their negotiations and settlements of land and property related issues with the provincial governors, security officials, private companies and individuals;• Establish a system that would enhance coordination between the Amlak Department and judiciary, provincial governors, police and other law enforcement agencies;• In coordination with the Ministry of Foreign Affairs, establish a system for registration of property of the Afghan embassies and consulates outside the country as well as identifying and registering property inside Afghanistan that belong to foreign entities and individuals;• Establish a data base to keep record of all property in the capital, provinces and at the Afghan embassies abroad;• Fully involve and train relevant civil servants in the design, development, and implementation of all of the abovementioned systems;• Develop guidelines and manuals that would ensure effective implementation of the abovementioned systems and mechanisms
2.3 DeliverablesThe deliverables of the Property Affairs Advisor are:• A standardized system for registration of public and property;• A system for identification of illegally occupied property and its re-possession;• A system for the resolution of property related conflicts in the capital and provinces;• A mechanism for ensuring coordination between the Amlak Department and other relevant stakeholders such as the judiciary, provincial governors, police and other law enforcement agencies;• A system for identification and registration of property belonging to Afghan missions abroad and property belonging to foreign entities and individuals inside the country;• A full-fledged database to keep record of all property in the capital, provinces and at that belonging to the Afghan missions abroad; • Guidelines and manuals that would ensure effective implementation of the abovementioned systems;• A well-functioning Amlak Department will capable staff fully trained in the abovementioned areas.
2.4 Skills, Experience and Qualifications RequiredThe successful candidate should have the following skills, experience and qualifications:• Must have Bachelors in law, policy or other relevant field of study; master’s degree highly desirable and preferred;• A minimum of 10 years of total work experience with 7 years relevant experience in area of property registration and/or legal field especially with government or public entity;• Previous experience with developing of database• Excellent IT skills with working knowledge of Ms-Office and soft wares related to database development;• Previous experience in under-developed, insecure or post-conflict environments a plus;• Experience with capacity development and training programs a big plus;• Excellent command of English; fluency in Pashto and Dari highly desirable;
Afghan expatriates and nationals of countries in Afghanistan’s region are especially preferred for this position.
